Terms of Service - FlavorlyAI

1. Agreement to Terms

By downloading, installing, or using the FlavorlyAI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

FlavorlyAI is an AI-powered recipe generation application that creates personalized recipes based on ingredients you provide. The App provides recipe suggestions, nutritional information, and cooking instructions. The recipes generated are suggestions only and should be used at your own discretion.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this eligibility requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

4. Subscriptions and Payments

Free Trial: FlavorlyAI offers a 7-day free trial of premium features when you first download the App. No payment method is required to start your free trial.

Paid Subscription: After your free trial expires, you must subscribe to continue accessing premium features. FlavorlyAI offers the following subscription options:

Monthly subscription: $4.99 per month (billed monthly)
Annual subscription: $49.99 per year (billed annually)

Billing and Renewal: Subscriptions are processed through the Apple App Store. By subscribing, you authorize us to charge your Apple ID account the applicable subscription fee at the end of your free trial and each billing period thereafter. Subscriptions automatically renew at the end of each billing cycle unless you turn off auto-renewal at least 24 hours before the end of the current period.

Subscription Management: You can view your subscription status, change your subscription plan, or cancel your subscription at any time through your iPhone settings. Go to Settings > [Your Name] > Subscriptions > FlavorlyAI and select "Manage Subscription" or "Cancel Subscription." If you cancel during a billing period, your access to premium features will continue until the end of that billing period, but you will not be charged for the next period.

Refunds: Refund requests are handled by the Apple App Store according to their refund policy. Please visit the Apple Support website for information on requesting refunds for subscriptions.

5. User Accounts

To access certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to gain unauthorized access to any portion of the App
Interfere with or disrupt the App or servers
Reverse engineer, decompile, or disassemble any portion of the App
Use the App to transmit harmful or malicious code
Reproduce, distribute, or create derivative works from the App content

7. Intellectual Property

The App and its original content, features, and functionality are owned by Flavorly and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8. Health and Safety Disclaimer

The recipes and nutritional information provided by Flavorly are generated by artificial intelligence and are for informational purposes only. They are not intended as medical or dietary advice. Always check ingredient labels and allergen information. If you have food allergies, dietary restrictions, or health conditions, consult with a healthcare professional before trying new recipes. Flavorly is not responsible for any adverse reactions or health issues resulting from the use of our recipes.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF THE RECIPES OR OTHER CONTENT PROVIDED THROUGH THE APP.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLAVORLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify, defend, and hold harmless Flavorly and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the App or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
